Jan Dobrý

Counsel

Jan Dobrý is a Czech law qualified Counsel specialising in all forms of dispute resolution, judicial review of administrative decisions and competition law. He leads the dispute resolution department at Clifford Chance Prague Association.

Jan has extensive experience in various forms of dispute resolution and is actively involved in disputes before the general Czech courts, the European Court of Justice, as well as disputes conducted in arbitration proceedings (both domestic and international).

Jan also provides advisory services and represents clients in administrative law and related judicial review of administrative decisions, both in competition law and other highly regulated fields such as pharmaceuticals and energy. Apart from his law degree, his university degree in economics enables him to understand the economic aspects of the cases he handles.

Jan is an arbitrator of the Arbitration Court at the Prague Stock Exchange and a permanent representative of Clifford Chance at the Commission for Environment and Energy and Commission on International Arbitration at ICC Czech Republic.

Relevant experience

  • Advising Seznam.cz, a leading internet search provider in the Czech Republic, in connection to their role as an intervener supporting the European Commission in the proceedings initiated by Google in an attempt to repeal the decision of the European Commission which imposed a fine of EUR 4.3 billion on Google based on its abuse of dominant position in relation to the Android operating system. The case is one of the most closely followed antitrust litigation today and a landmark example of European Commission's approach to the digital markets and its major players.
  • Advising UK-based pharmaceutical producer on all aspects of distribution of its products in the Czech Republic, including regulatory and corporate issues.
  • Advising Czech subsidiary of global electronics manufacturer on dispute with its e-waste management service provider established by the client and other leading players on the Czech market in order to fulfil the obligations stemming from the e-waste regulation.
  • Advising a regional investment company as defendant within arbitration commenced with Vienna International Arbitral Centre by a developer of a prototype vehicle.
  • Defending the Czech subsidiary of a major civil engineering company against the Czech Competition Office in relation to alleged bid-rigging case.
  • Advising a major Czech steelmaking company in connection with a claim filed before German courts.two leading Czech construction companies in arbitration and subsequent court proceedings with the Road and Motorway Directorate of the Czech Republic (RMD) for an action brought by RMD for alleged overpricing of a work under a construction contract related to a section of a national highway.
  • Advising a leading European property developer in arbitration proceedings against the Road and Motorwary Directorate of the Czech Republic (RMD) in connection with the performance of a future agreement on the purchase of land by RMD and in associated court proceedings involving RMD and the Czech Ministry of Transport.
  • Advising Citibank on the structuring and sale of its retail banking and credit card businesses in the Czech Republic to Raiffeisenbank.
  • Advising Česká spořitelna on the defence of procedural and substantive rights in the insolvency proceedings concerning Oděvní podnik (OP Prostějov), a major Czech clothing producer including litigation at appellate and constitutional review level.
